Terms of Service

Please read these terms carefully before using PodDojo.

1. Agreement to Terms

By creating an account or using PodDojo in any way, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. These Terms constitute a legally binding agreement between you and MD&A INC. operating as Make More Creative, the company that operates PodDojo.

If you do not agree to these Terms, do not use PodDojo.

2. The Service

PodDojo is a white-label podcast management platform that allows creators to operate branded podcast websites with AI-powered content tools, guest pipeline management, a merch shop, and analytics. Each show on PodDojo operates independently under its own branding.

We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will provide reasonable notice of material changes where possible.

3. Accounts

  • Age requirement: You must be at least 18 years of age to create an account and use PodDojo.
  • Accurate information: You agree to provide accurate, current, and complete information when creating your account and to keep that information up to date.
  • Account security: You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@makemorecreative.com if you suspect unauthorised access.
  • One account per person: Each account is for a single individual or organisation. You may not share accounts.

4. Subscriptions & Billing

  • Recurring billing: PodDojo subscriptions are billed on a recurring monthly basis via Stripe. By subscribing, you authorise us to charge your payment method automatically at the start of each billing period.
  • Plan tiers: We offer Starter ($29/mo), Pro ($79/mo), and Enterprise (custom) plans. Plan features and limits are described on the Pricing page.
  • Upgrades: Upgrades take effect immediately. The cost difference is prorated for the remainder of the current billing period.
  • Downgrades: Downgrades take effect at the end of the current billing period.
  • Cancellation: You may cancel your subscription at any time through your billing settings. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods.
  • Free trials: If you begin on a free trial, you will not be charged until the trial period ends. You may cancel before the trial ends without charge.

5. Your Content

  • You own your content: All episodes, articles, guest records, and other content you upload or create in PodDojo remains your property.
  • Licence to us: By uploading content, you grant MD&A INC. a limited, non-exclusive, royalty-free licence to store, host, and process your content solely for the purpose of providing the PodDojo service to you.
  • AI-generated content: Content generated by PodDojo's AI features (show notes, blog articles, social posts) based on your transcripts belongs to you. We do not claim any ownership over AI-generated outputs.
  • No training use: Your content is not used to train AI models. Transcripts submitted for AI generation are processed by Anthropic's API under terms that prohibit training use.

6. Acceptable Use

You agree not to use PodDojo to:

  • Upload, publish, or distribute any content that is illegal, defamatory, harassing, or infringes the intellectual property rights of others.
  • Distribute spam, unsolicited commercial communications, or malware through the platform.
  • Abuse the AI content generation features by submitting excessive requests designed to circumvent plan limits or overload our systems.
  • Attempt to gain unauthorised access to other accounts, the platform infrastructure, or Supabase data outside your own show.
  • Use the platform in any way that violates applicable Canadian or international law.

Violation of these terms may result in immediate suspension or termination of your account.

7. White-Label Usage

PodDojo is a white-label platform. Your show's branding — name, logo, colours, domain — is yours and is presented to your audience as your own. PodDojo's name and branding are not displayed to your audience unless you choose to include them.

While your show branding is yours, the PodDojo platform infrastructure, software, and underlying technology remain the intellectual property of MD&A INC. You are licensed to use the platform, not to own or resell it.

8. Intellectual Property

The PodDojo platform — including all software, design, UI, AI pipelines, documentation, and branding — is the intellectual property of MD&A INC. and is protected by copyright and other applicable laws.

Your show content — episodes, articles, guest records, your logo, your brand assets — remains your intellectual property. Nothing in these Terms transfers ownership of your content to us.

9. Limitation of Liability

To the maximum extent permitted by applicable law, MD&A INC. and its directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or business opportunities — arising from your use of PodDojo or inability to use the service.

Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to PodDojo in the 12 months preceding the claim.

Nothing in these Terms limits our liability for fraud, gross negligence, or any liability that cannot be excluded under applicable law.

10. Termination

Your right to cancel: You may cancel your subscription and close your account at any time through your account settings.

Our right to suspend: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if continued access poses a risk to other users or our infrastructure. Where possible, we will provide notice before taking action.

After termination: Following cancellation or termination, your data remains available for 30 days so you can export anything you need. After 30 days, all data is permanently deleted.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Alberta, Canada.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email at least 30 days before the changes take effect. If you continue to use PodDojo after the updated Terms take effect, you are agreeing to the revised Terms.
